Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of pwa.today and the related PWA Today services (the “Services”), provided by bitBuilders (“bitBuilders”, “we”, “us”, or “our”). By creating an account or using the Services, you agree to these Terms.
1. The Services
PWA Today provides tools for testing, auditing, monitoring, and evaluating progressive web applications, including runtime audits, service-worker checks, notifications, API access, and related account features. We may change, improve, suspend, or discontinue parts of the Services. We will use reasonable efforts to provide advance notice of material changes where practicable.
2. Eligibility and authority
You must be at least 18 years old to create an account or use the Services. If you use the Services for an organisation, you confirm that you have authority to bind that organisation to these Terms.
3. Contract formation and consumer rights
The contract begins when we accept your account signup or paid order. The applicable plan, price, usage allowance, and any terms shown during checkout form part of the contract. If there is a conflict, a specific order or plan term controls over these general Terms, and a signed data-processing agreement controls over these Terms for processing covered by that agreement.
If you are a consumer, mandatory consumer rights apply. You may have a 14-day right of withdrawal for an online service. The applicable withdrawal information and model form are available in our Withdrawal notice and will be provided before checkout where required. If you expressly ask us to start providing a service during the withdrawal period, we may charge the proportionate amount for the part supplied before withdrawal. If a service is fully performed during that period, the right of withdrawal ends only where you gave the legally required express consent and acknowledgement.
4. Withdrawal, conformity, and refunds
Consumers retain all mandatory statutory rights relating to withdrawal, delivery, digital-service conformity, repair or restoration, price reduction, termination, and refunds. Nothing in these Terms restricts those rights. Where a consumer withdraws or terminates a contract under applicable law, we will process any required refund using the legally required method and timeframe.
5. Accounts and security
- Provide accurate, current information and keep it updated.
- Keep your password, passkeys, API credentials, and access tokens secure.
- Do not share account access or allow unauthorised use.
- Notify us promptly at info@pwa.today if you suspect unauthorised access.
You are responsible for activity under your account, except to the extent that applicable law provides otherwise or the activity was caused by our failure to apply reasonable security measures.
6. Acceptable use
You must not use the Services to:
- break the law, infringe rights, or violate another person’s privacy;
- test or scan systems without appropriate authorisation;
- upload malware, exploit code, credentials, payment-card details, or other unnecessary sensitive data;
- interfere with, overload, reverse engineer, or bypass security controls of the Services;
- circumvent plan limits, rate limits, billing controls, or access restrictions; or
- use audit results to make a high-risk decision where independent verification is required.
7. Plans, payments, and cancellation
- Prices, included usage, and plan limits are shown on the pricing or checkout pages.
- Stripe processes payments and subscriptions on our behalf. Payment-card details are handled by Stripe and are subject to Stripe’s terms.
- Subscription charges recur according to the billing interval shown at checkout until canceled.
- You may manage eligible subscriptions through the billing portal made available in the console.
- Taxes, including VAT, may be added where required by law.
- Audit packs and other one-time purchases may have an expiry or usage period shown at purchase.
Cancellation normally applies to future renewals. Refunds are handled according to applicable law and any specific terms shown at checkout. We will clearly show the billing interval, renewal price, and cancellation method before a consumer starts a subscription. Nothing in these Terms limits mandatory consumer rights. If we discontinue or suspend a paid service for a reason not caused by your breach, non-payment, misuse, or a legal or security requirement, you may be entitled to a proportionate refund or price reduction for the unused part of the paid period.
If a payment fails or an account exceeds its plan limits, we may restrict paid features, pause processing, or request a plan change after giving any notice required by law. We do not charge for a higher plan unless you select it or otherwise authorise the change.
8. Audit results and service limitations
Audit results are technical assessments based on the configuration, network conditions, browser environment, and application state at the time of testing. They are provided for information and engineering assistance only. Results are not a guarantee of security, availability, accessibility, regulatory compliance, or performance, and do not replace professional testing or review.
You are responsible for ensuring that URLs, applications, content, and systems submitted to the Services may lawfully be tested.
9. Availability, third parties, and limits
Availability may be affected by maintenance, internet connectivity, browser behavior, cloud infrastructure, payment providers, push providers, DNS, or other third-party services. We do not promise a particular uptime unless a separate written service-level agreement says otherwise.
Plans may limit applications, audits, notifications, API requests, concurrency, storage, or other usage. We may reject, delay, or throttle requests that exceed a plan or technical limit. We will identify applicable limits on the pricing, checkout, or console pages.
10. Intellectual property and feedback
We and our licensors own the Services, software, branding, and related materials. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business or personal purposes during your account term.
You retain rights in content and application information you submit. You grant us the rights necessary to host, process, test, secure, and provide the Services. If you provide feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.
11. Customer data, export, and deletion
You retain rights in customer data, application information, configurations, and audit content that you submit. During your account term, you may access the data made available through the console and API. You should download or otherwise retrieve any information made available through those interfaces before requesting deletion. Contact us if you need help identifying an available export. After account closure, we delete or anonymise data according to the Privacy Policy.
We may retain billing, security, legal, and other records where the Privacy Policy or applicable law permits or requires it. Backups may retain deleted data for a limited period until they expire or are overwritten.
12. Confidentiality and data protection
Each party will use reasonable care with non-public information received through the Services. Our processing of personal data is described in the Privacy Policy. You remain responsible for deciding what information to submit and for having the rights and permissions needed to submit it.
If you use the Services to process personal data on behalf of another person or organisation, you are responsible for ensuring that the processing is authorised. Where bitBuilders processes personal data as your processor, the parties should enter into a separate Data Processing Agreement. The Privacy Policy and our documented provider safeguards apply alongside that agreement.
13. Security reporting
Report suspected vulnerabilities or security incidents to info@pwa.today. Do not access, alter, exfiltrate, or disclose data that does not belong to you, and do not publicly disclose a vulnerability before giving us a reasonable opportunity to investigate and respond, except where applicable law requires otherwise.
14. Suspension and termination
We may suspend or limit access where reasonably necessary to protect the Services, investigate abuse, address non-payment, comply with law, or prevent security or operational harm. We may terminate an account for a material or repeated breach of these Terms. You may stop using the Services and request account deletion through the console, subject to retention of information we must keep by law or for legitimate security, dispute, or accounting purposes.
15. Warranties and disclaimers
To the maximum extent permitted by law, the Services are provided on an “as available” and “as is” basis. We do not promise that the Services will be uninterrupted, error-free, completely secure, or suitable for every purpose. We disclaim warranties only to the extent permitted by applicable law. For consumers, this does not limit statutory digital-service conformity rights or remedies.
16. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or intentional misconduct.
To the maximum extent permitted by law, bitBuilders will not be liable for indirect, incidental, special, consequential, or lost- profit damages arising from your use of the Services. For paid Services, our total liability for claims arising from the Services will not exceed the amount you paid us for those Services during the 12 months before the event giving rise to the claim. This limit does not apply where prohibited by applicable law. For consumers, nothing in this clause limits statutory rights, conformity remedies, refund rights, or liability that cannot lawfully be excluded or limited.
17. Changes to these Terms
We may update these Terms by publishing a revised version and updating the date above. If a change materially affects your rights or obligations, we will provide advance notice and explain the change where required. For consumer contracts, a change that negatively affects access to or use of a digital service does not become binding solely because you continue using the service; where required by law, you may terminate without charge. If you do not agree, contact us about cancellation or account closure. We will not use a Terms update to remove mandatory statutory rights.
18. General terms
Neither party is responsible for delay or failure caused by events beyond its reasonable control. If a provision is invalid or unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, except as part of a permitted transfer of your business; we may assign them as part of a merger, restructuring, or sale of the relevant business. These Terms, the applicable plan or order, the Privacy Policy, and any Data Processing Agreement form the agreement between you and us for the Services.
19. Applicable law and disputes
These Terms are governed by the laws of the Netherlands, without prejudice to mandatory protections that apply to consumers in their country of residence. Subject to those mandatory protections, disputes will be submitted to the competent courts in the Netherlands.
